The setting up of local governments in Malawi is provided for in Section 146 of the national Constitution. The Local Government Act of 1999 (revised in 2011) establishes local governments and describes their powers and functions. In addition Malawi has a Decentralization Policy (October 1998 revised in 2010) which creates a democratic environment and institutions for governance and development at the local level.
Malawi is divided into 28 District Councils 4 City Councils and 2 Municipal Councils. The councils are administered by regional administrators and district commissioners who are appointed by the central government. The Ministry of Local Government and Rural Development spearheads the decentralization process. A Cabinet Committee on Rural transformation and Decentralization and an Inter-ministerial Technical Committee on Rural Transformation and Decentralization were also created to ensure successful implementation. There are several Decentralization Sectors within the Ministry of Local government to monitor the decentralization process. The representative body for local councils in Malawi is the Malawi Local Government Association (MALGA).
Constitutionally mandated local elections are to be held one year after presidential and parliamentary elections. The first local elections in the multi-party era took place on November 21st 2000. The second round of local elections, originally scheduled for May 2005, were postponed several times.After a successful start with the national government promoting and legislating far-reaching decentralization policies from 1994 onwards, the current status of local government is weakened due to the repeated postponement of local government election. Once local government elections are held, Malawi can re-open the political arena, putting renewed emphasis on decentralization and allow the necessary contemporary changes to take place.
