The Constitution of Mozambique (1996) accommodates the legal framework for decentralization and Municipalities in Mozambique The constitution states the importance of local government because of several important functions these local organs of the state can fulfill. In addition, the Local Government Act of 1997 provides for the establishment of local authorities and outlines their administrative and financial powers.

Mozambique is divided into 10 provinces and 33 municipalities. The Minister of State Administration has overall responsibility for local government matters, exercising his or her powers under Law No. 7/97. The Association of National Authorities in Mozambique (ANAMM) is the representative body for local government in Mozambique.

Local officials are elected for a term of five years. The most recent local elections were held in November 2008. The next local elections for local government are due in 2014 securing the continuation of decentralization policies.
