Zambia

GENERAL INFORMATION ON LOCAL GOVERNMENT

 

Local government is enshrined in the Constitution in Zambia. It is further elaborated in the Local Government Act of 1991 which stipulates the powers and functions of local governments. Zambia also has an elaborate National Decentralization Policy which provides a roadmap for the decentralization process. The decentralization process has been re-introduced several times. International as well as domestic politics overshadowed the implementation of decentralization in 1968 and 1980. In 2002 the government introduced a decentralization policy with the ultimate goal; the devolution of the Zambian state in favor of localities and the people of Zambia. De-concentration was to be the first step, strengthening democracy and governance in the 9 provinces and 72 sub-districts of Zambia. The districts are divided into cities, urban municipalities and rural districts. The characteristics of these different localities are derived from their rural or urban nature. Legally, the different districts have the same rights and duties. Local governments in Zambia fall under the Ministry of Local Government and National Housing. The Local Government Association of Zambia (LGAZ) is the representative body for local governments in Zambia.

 

Local councils are elected on a five year basis and have the discretion to establish councils corresponding with the needs of the locality. District councils are elected locally through individual administrative wards. One member per ward is elected and takes place in the district council, local chiefs elect two representatives who also take place in the council. Responsibility for water and sanitation, law enforcement, health etc. lay with the councils who receive grants from the national government. Further financial means are obtained through local taxes.

 

In order to streamline local government elections on the local level were put parallel to presidential and parliamentary elections. Although the 2010 amendment to the Local Government Act once more put local government on the map, the following committee on the amendment showed that without financial support it was hard to reach sustainable decentralization policies.
